Terms of Service

By downloading, installing, or using Driver Apex Companion, you agree to these Terms of Service. If you do not agree, do not use the app.
1. Who We Are
Driver Apex Companion is an independent app developed by Danilo Castro (support@driverapex.com). "We", "us", and "our" in these terms refer to the developer individually. "You" and "your" refer to the person using the app.
2. What the App Does
Driver Apex Companion reads UDP telemetry data broadcast by supported racing games (currently Gran Turismo 7 and Assetto Corsa Competizione) and uses it to provide lap analysis, sector timing, predictive turn-by-turn feedback, and on-device AI coaching insights. All processing happens locally on your device.
3. Third-Party Game Data — No Guarantee of Continuity
The app depends entirely on telemetry data transmitted by third-party games over UDP. We have no control over those games, their developers, or their publishers. Game updates, patches, or business decisions may alter, break, or permanently remove the telemetry protocol at any time and without notice.
We are not responsible for any loss of functionality caused by a game changing its data format, reducing the information it broadcasts, or ceasing to transmit telemetry data altogether. We will make reasonable efforts to release updates that restore compatibility when a supported game changes its protocol, but we cannot guarantee the timeline, feasibility, or outcome of such efforts. Compatibility updates are provided at our sole discretion and are not guaranteed.
The following scenarios are outside our control and do not constitute a defect in the app or grounds for a refund:
- A game update alters or removes UDP telemetry output.
- A game's publisher discontinues the title or its online services.
- A console firmware update restricts local network communication.
- A game adds copy protection or encryption to its telemetry stream.
4. AI Coach — Experimental Feature
The AI Coach feature is experimental. It uses a language model running entirely on your device to generate per-corner insights. Results may be incomplete, inaccurate, or unavailable depending on your device's processing capacity, available memory, and thermal state.
AI Coach insights are provided for informational and entertainment purposes only. They are not professional coaching advice. We make no representation that following AI Coach suggestions will improve your lap times, prevent damage to vehicles, or be appropriate for your specific driving conditions.
5. Subscription, Billing, and Pricing
Billing is managed by the platform stores. All payments, receipts, refunds, and subscription management are handled exclusively by Apple (App Store) or Google (Google Play) under their respective terms of service. We do not process payments directly and do not have access to your payment details.
Free trial. A free trial period may be offered at our discretion. The duration and availability of free trials may change at any time. The trial begins when you confirm it through the platform store. You will not be charged until the trial period ends.
Subscription price. The subscription price may be changed at any time at our sole discretion. Price changes take effect at the start of the next billing cycle following the change. The platform store will notify you of any price change before it applies to your subscription. Continued use of the app after a price change constitutes acceptance of the new price.
Cancellation. You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current paid billing period. You retain full access to all premium features until that period expires. We do not offer pro-rated refunds for unused time within a billing period, except where required by applicable law or where a refund is granted by the platform store under their own policies.
Refunds. All refund requests are handled by Apple or Google under their respective refund policies. We do not issue refunds directly.
6. App Provided "As Is"
The app is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be error-free, uninterrupted, or free of bugs. Features may be added, modified, or removed at any time.
7. Limitation of Liability
To the fullest extent permitted by applicable law, we exclude all liability of any kind — including indirect, incidental, special, consequential, or punitive damages such as loss of data, loss of revenue, or loss of enjoyment — whether arising in contract, tort, or otherwise, from your use of or inability to use the app, even if we have been advised of the possibility of such damages.
Where the law of your jurisdiction does not permit a complete exclusion of liability, our liability is limited to the minimum extent required by that law. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.
8. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or disassemble any part of the app.
- Use the app for any unlawful purpose.
- Attempt to circumvent the subscription system or access premium features without a valid subscription.
- Redistribute or resell the app or its content.
9. Intellectual Property
All content, design, and code in the app and on this website are owned by the developer and protected by applicable intellectual property laws. Gran Turismo 7 is a trademark of Sony Interactive Entertainment. Assetto Corsa Competizione is a trademark of Kunos Simulazioni. Driver Apex Companion is an independent product and is not affiliated with, endorsed by, or sponsored by any game publisher.
10. Changes to These Terms
We may update these terms at any time. The "last updated" date at the top of this page reflects the current version. Continued use of the app after changes are posted constitutes acceptance of the revised terms. For material changes, we will make reasonable efforts to notify you via app update notes.
11. Governing Law
These terms are governed by the laws of Ireland. Any disputes arising from these terms or your use of the app shall be subject to the exclusive jurisdiction of the courts of Ireland, without regard to conflict of law principles.
